10. Product Availability

All promotional campaigns have limited and exclusive stock for online sales. GlobalPhoneAccessories will only process an order placed by a Customer after confirming the respective payment. Therefore, GlobalPhoneAccessories cannot guarantee the availability of the items until the start of the mentioned processing. At the time of checkout, the Customer will find the estimated delivery date and the destination of the order. GlobalPhoneAccessories only ships on working days. Therefore, weekends and holidays are not considered for estimating delivery times. However, the estimated delivery dates are merely indicative. If any ordered product is unavailable, and after contacting the supplier to inquire about the possibility of restocking the missing item, GlobalPhoneAccessories will contact the customer if the delivery time or price of the item changes, and the order will proceed only with the customer's consent. In case of absolute unavailability of the ordered product, GlobalPhoneAccessories may propose to the Customer the supply of an equivalent quality and price product, if available. Any delay in the shipment of items, in relation to the estimated dates presented, does not entitle the Customer to any compensation.

11. Shipping Costs

There are 3 shipping methods available to Portuguese customers: CTT Registado, CTT Azul, and CTT Express, and for international customers, CTT Express. Each time an item is shipped, an automatic email notification is sent to the customer. Invoices are issued electronically (Moloni). The shipping cost is valid for all European Union countries without exception. Shipping is free for all orders with the CTT Azul shipping method in Portugal and CTT Express for other European Union countries starting from 39.90 at GlobalPhoneAccessories.com. Outside this condition, shipping costs will always be charged. For orders equal to or above 19.90€ (nineteen euros and ninety cents), GlobalPhoneAccessories reserves the right to ship the orders with a tracking number to the customer, even if the customer did not request shipping with a tracking number. Orders with tracking numbers can be delivered directly to the designated address's mailbox if the package does not exceed 24cm in width and 3.5cm in thickness and has a weight below 100g. In this situation, the orders are delivered directly to the mailbox and marked by the courier as delivered to the indicated address. The proof of delivery is provided by the information available on the carrier's website (www.ctt.pt) and the indication of the order status on the delivery note carried by the courier. In the case of orders weighing more than 100g or with dimensions exceeding 24cm in height and 3.5cm in thickness, delivery can only be made upon physical receipt by someone present at the designated address. In cases of returned orders due to unknown, incomplete, or incorrect addresses, GlobalPhoneAccessories will only re-ship the item to the customer upon additional payment of the shipping costs for the second shipment. The shipping and cost values will be calculated according to the current CTT table, based on the weight of the item(s) to be shipped and the chosen shipping method initially selected by the customer. If the customer does not accept paying for the shipping costs of the second shipment, GlobalPhoneAccessories cannot be held responsible for re-shipping the order and will proceed with the refund of the amount paid by the customer.

12. Cancellations, Exchanges, and Returns

Product exchange is only allowed during the first 15 days after purchase, without the need for any justification, provided that the products are in new condition, without any signs, scratches, or marks of use. In the case of screen protectors, they must not have been detached from the protective labels (which protect the side that adheres to the screen) in order for their exchange or return to be possible. To exchange a product, the operation can only proceed after the customer has delivered the respective item. In case of non-conformity of the goods with the contract, the Customer has the right to have it restored without charges, through repair, replacement, or resolution if the first solutions are not feasible. The term "without charges" referred to in the previous paragraph refers to the expenses necessary to restore the goods in accordance with the contract, including, in particular, transportation expenses (excluding additional costs resulting from the customer's choice of a shipping method other than the least expensive standard shipping method offered by us), labor, and material. This means that if the warranty claim is denied, the Customer will have to bear the transportation costs of the operation. The exchange will only be possible upon presentation of the original purchase invoice by the customer.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the contract without indicating any reason within 15 days from: a) The day of the conclusion of the contract, in the case of service contracts; b) The day on which the Customer or a third party, other than the carrier and indicated by the Customer, acquires physical possession of the goods (in orders without a tracking number, the deadline starts from the estimated delivery date, depending on the chosen shipping method), in the case of purchase and sale contracts; or: i) The day on which the Customer or a third party, other than the carrier, acquires physical possession of the last good, in the case of several goods ordered by the Customer in a single order and delivered separately; ii) The day on which the Customer or a third party, other than the carrier, acquires physical possession of the last lot or piece, in the case of delivery of goods consisting of multiple lots or pieces; iii) The day on which the Customer or a third party, other than the carrier, acquires physical possession of the first good, in the case of contracts for the regular delivery of goods over a defined period; The exercise of the right of withdrawal does not affect the Customer's right to inspect, with due care, the nature, characteristics, and functioning of the goods. The Customer may be held liable for the depreciation of the goods if the handling carried out to inspect the nature, characteristics, and functioning of the goods exceeds the handling that is usually allowed in a retail store. To exercise the right of withdrawal, the Customer must communicate their decision, by means of a clear and unequivocal statement, to xxxxxxxxxxx., headquartered at Rua xxxxxxxxx, or by email to sac@globalphoneaccessories.com. If payment for the product(s) has been made by Multibanco, PayPal, credit card, or MBWAY, the Customer must provide their tax identification number so that the refund of the total payment received can be made. Within a maximum period of 15 days from the date of the communication of the withdrawal decision, the Customer must return the goods to GlobalPhoneAccessories, with the return costs being borne by the Customer. Upon receiving the item(s) from GlobalPhoneAccessories, the Customer will be refunded the total payment received, within 15 days, using the same payment method used by the Customer to purchase the product. In cases where the Customer does not return the goods or does not provide proof of the return, GlobalPhoneAccessories reserves the right to withhold the refund until the situation is resolved. The Customer cannot exercise the right of withdrawal when: 1) The 15-day period has elapsed; 2) The product, after its delivery, by its nature, becomes inseparably mixed with other items; 3) Supply of sealed audio or video recordings or sealed computer software, which the customer has removed the seal of inviolability after delivery; 4) Purchase of auctioned products; 5) Items that, by their nature, cannot be returned or are susceptible to deterioration.

13. Consumer Goods Warranty and After-Sales Assistance

The products sold by GlobalPhoneAccessories on the website www.globalphoneaccessories.com are covered by the legal warranty regime, in accordance with the provisions of Decree-Law No. 67/2003, of April 8, with amendments introduced by Decree-Law No. 84/2008, of May 21. All electronic equipment (except batteries) sold on www.globalphoneaccessories.com are covered by a conformity warranty for a period of 2 (two) years. Upon receiving the order, the Customer must check its condition and, if any anomaly or problem is found, immediately contact globalphoneaccessories.com (by email) to report the situation and provide as much detail as possible about the problem. After reporting the defect, the Customer must allow GlobalPhoneAccessories to analyze the products. The inspection of the defective product takes place at GlobalPhoneAccessories' premises. The Customer can exercise the rights indicated in this clause when the lack of conformity becomes apparent within a period of two years from the delivery of the goods. For articles and equipment that are easily perishable due to their nature, the Customer has a warranty period of six months, provided that the defect does not result from the equipment's misuse. In case of non-conformity of the goods with the contract, the Customer has the right to have it restored without charges, through repair, replacement, or resolution if the first solutions are not feasible. The term "without charges" referred to in the previous paragraph refers to the expenses necessary to restore the goods in accordance with the contract, including, in particular, transportation expenses (excluding additional costs resulting from the customer's choice of a shipping method other than the least expensive standard shipping method offered by us), labor, and material. This means that if the warranty claim is denied, the Customer will have to bear the transportation costs of the operation. The Customer can exercise any of the rights referred to in this clause, unless it is impossible or constitutes an abuse of rights, under general terms. The term "lack of conformity" refers to the product being delivered in accordance with the technical characteristics stated in its description and free from any defects or faults that may diminish its economic value and usefulness. However, any defects in the products resulting from normal wear and tear caused by use and the passage of time, damage during transportation carried out by the Customer, incorrect use, or repairs made without the express and written declaration of GlobalPhoneAccessories' knowledge will not be covered by the warranty. To activate the warranty, it is necessary to send the product with the respective purchase invoice by the Customer. In the case of goods outside the warranty period, the Customer may still request that the item be repaired, and for that, they can inform and send the defective or faulty items to sac@globalphoneaccessories.com. The items will be analyzed by GlobalPhoneAccessories' After-Sales Service, in conjunction with the Technical Assistance of the brand, which will issue a technical opinion and the respective repair estimate. The repair will only begin after the Customer expressly accepts the estimate.

14. Applicable Law and Online Dispute Resolution

All purchases made on the website www.globalphoneaccessories.com are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Terms and Conditions of Contracting and Use will be submitted to the competent Portuguese court.
